Terms of Service
F&M Engineering Services — Gmail Automation and Engineering Tools
1. Acceptance of Terms
By accessing or using the F&M Engineering Services Gmail automation platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms apply to your use of the n8n-based automation platform accessed at n8n.fmes.online (or the equivalent internal address) and any associated Gmail automation features.
2. Description of Service
F&M Engineering Services provides a self-hosted workflow automation platform that allows you to connect your Google account and automate email processing tasks. The Service includes:
- A web-based workflow editor for creating and managing automation workflows
- Integration with Google Gmail API for reading, sending, and managing emails
- Integration with Google Calendar API (if enabled)
- Connections to third-party services as configured in your workflows
Our engineering calculators (timber design, wind load analysis) are separate tools that run entirely in your browser and are not covered by these Terms beyond the general disclaimers in Section 10.
3. Eligibility
You must be at least 18 years old or the age of majority in your jurisdiction to use this Service. You represent that you have the legal right and authority to enter into these Terms and to grant the permissions requested by the Service.
4. User Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- Configuring your workflows accurately and reviewing their behavior
- Ensuring that your use of the Service complies with all applicable laws and regulations
- Granting only the minimum necessary permissions to the Service via Google OAuth
- Regularly reviewing and updating your workflow configurations
5. Authorized Use
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service to send spam, unsolicited bulk email, or deceptive messages
- Use the Service to harass, threaten, or harm others
- Use the Service to violate any applicable law, regulation, or third-party rights
- Attempt to reverse-engineer, decompile, or extract source code from the Service
- Access or use the Service in a way that exceeds the permissions granted via Google OAuth
6. Automated Actions and Risk
6.1 Nature of Automation
The Service enables you to create automated workflows that perform actions on your behalf, including sending emails, applying labels, and processing messages. Once configured and activated, these workflows run automatically based on your triggers and conditions.
6.2 User Review Responsibility
You are solely responsible for reviewing and testing your workflow configurations before activating them. Automated actions can have real-world consequences — including sending emails to the wrong recipients, applying incorrect labels, or processing data unexpectedly.
6.3 No Guarantee of Error-Free Operation
We do not guarantee that the Service will operate without errors or interruptions. You should monitor your workflows and review their execution logs regularly.
6.4 Data Loss Risk
Automated actions may result in data modifications (e.g., email deletion, label changes) that cannot be undone through the Service. You are responsible for maintaining your own backups of important data.
Gap: A workflow testing and review procedure is not defined — establish guidance for users before publishing.
7. Privacy and Account Permissions
Your use of the Service requires granting Google OAuth permissions to access your Gmail and/or Calendar data. The specific permissions are displayed during the OAuth consent flow and are described in our Privacy Policy.
By connecting your Google account, you authorize the Service to access your data within the scopes you approve. You may disconnect your account at any time from the n8n credential management screen.
We refer you to the Privacy Policy for detailed information about how your data is handled.
8. Third-Party Dependencies
8.1 Google Services
The Service depends on Google's Gmail API and optionally Google Calendar API. If Google changes its API terms, discontinues the API, or restricts access, the Service may be affected. We are not responsible for Google's actions or API availability.
8.2 Third-Party Integrations
Your workflows may connect to third-party services (e.g., databases, notification services, cloud storage). These services are governed by their own terms and privacy policies. You are responsible for ensuring you have the right to connect your data to these services.
Gap: The list of supported or commonly used third-party integrations is not enumerated — update this section to reflect actual integrations before publishing.
9. Intellectual Property
The Service and its software are owned by F&M Engineering Services and are protected by applicable intellectual property laws. You do not acquire any ownership rights in the Service by using it.
You retain ownership of your data, including emails, workflow configurations, and any content you process through the Service.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:
- Merchantability or fitness for a particular purpose
- Accuracy or completeness of automated results
- Uninterrupted or error-free operation
- Security of data transmission or storage
We do not warrant that the Service will meet your specific requirements or that it will be error-free.
11. Limitation of Liability
To the maximum extent permitted by law, F&M Engineering Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including:
- Loss of data, email messages, or business opportunities
- Costs incurred due to automated actions you configured
- Damages arising from third-party service failures
- Any damages arising from unauthorized access to your account
Our total liability for any claim arising out of these Terms shall not exceed the amount you have paid for the Service (if any).
12. Suspension and Termination
12.1 By You
You may stop using the Service at any time by disconnecting your Google account and ceasing workflow activation.
12.2 By Us
We may suspend or terminate access to the Service if:
- You breach these Terms or engage in unlawful activity
- We are required to do so by law or legal process
- The Service becomes technically unsustainable to maintain
Upon termination, your OAuth access to Google data is revoked. Data stored on our servers may be deleted according to our retention practices.
12.3 Survival
Sections 9 (Intellectual Property), 10 (Disclaimer), 11 (Limitation of Liability), and 13 (Governing Law) survive termination of these Terms.
13. Governing Law
